OBJECT
These general and particular conditions regulate the contracting of the lockers owned by the entity. Lockers for Freedom SL through the website www.lockersforfreedom.com as well as through the touch screen located in the commercial premises in Cádiz, at Calle Sacramento 3, as well as its use. Likewise, these conditions regulate the contractual relationship between Lockers for Freedom, SL (owner of the lockers Lockers for Freedom and the User who hires the locker service Lockers for Freedom
The parties will be referred to interchangeably as Lockers for Freedom o, Lockers for Freedom SL and User or Client.
THE SERVICE
Lockers for Freedom offers its Users the possibility of renting any of its lockers for periods of calendar days (within the hours offered by Lockers for Freedom).
What kind of slogans do you offer Lockers for Freedom?
Lockers for Freedom offers two types of slogans:
- Medium lockers (M), whose measurements are 580mmX436mmX293mm. These lockers fit approximately 1 cabin suitcase and a small backpack.
- Large lockers (L), whose measurements are 580mmX436mmX560mm. These lockers fit approximately 2 cabin suitcases and a medium backpack.
- Extra large lockers (XL), whose measurements are 580mmX436mmX856mm. These lockers fit approximately 4 cabin suitcases or a very large suitcase or a large suitcase and a cabin suitcase.

The rental service of each locker will be accessible at the times indicated in the business premises, every day of the week, 365 days a year, 24 hours a day.
Once the packages have been inserted by the User, can they only access the ticket office again to remove them?
No. Once the user has inserted the bags, they can re-access the locker as many times as they wish, leaving it closed and empty at all times and closed at the end of the rental period.
What is the price that the User must pay per type of box office/day?
- Pricing
The prices applicable to each product are those indicated on the website itself at the time of purchase. The final prices that appear on the web and on the touch screen include VAT and refer to the rental of a locker (according to its size) per calendar day (from 7.00:6.59 am to XNUMX:XNUMX pm).
The offers will be duly marked and identified as such, conveniently indicating the previous price and the price of the offer.
Lockers for Freedom reserves the right to make any modifications it deems appropriate on the website and in the commercial premises at any time and without prior notice, and may update products and services daily based on the market.
- Payment method
Purchases can be paid by any of the means indicated on the website at the time of making the reservation or on the touch screen located in the business premises. Specifically, by credit or debit card.
How are lockers reserved and used?
The lockers offered through Lockers for Freedom They are fully automatic.
Locker reservations can be made through the website www.lockersforfreedom.com.
The User must access the website www.lockersforfreedom.com and go to the reservations section. In this section, you must select the number of lockers, size and reservation period. You must also enter your name, surname, mobile phone and email address.
Once these Conditions have been accepted and the card payment has been made and the contracting completed, the User will receive confirmation of the contracting carried out, the reserved locker number or lockers, via email and/or SMS on their mobile phone. and your security code to access both the premises and your locker(s).
On the day of the reservation, at the door of the commercial premises, the User must type in the tactile keyboard enabled next to the main entrance door, the code that was sent by email and/or by SMS when making the reservation. If the code is correct, the main door will open and the User will be able to access the business premises.
Once inside the commercial premises, the User must go to the touch screen found in one of the ticket offices and re-enter the reservation code. If the code is correct, the contracted ticket office will open automatically.
Therefore, the User will only be able to access their locker through the security code provided via email and/or SMS sent to the telephone number provided at the time of making the reservation. For this reason, Lockers for Freedom, SL is not responsible if the User incorrectly gave said information when making the reservation and did not receive the security code for reasons attributable to the User.
Once the reservation number entered on the touch screen is confirmed, the assigned locker will be automatically opened, allowing the User to deposit their suitcases or other permitted objects and leaving it closed each time they open it, even when they definitively remove their belongings.
What should the User do when they want to finalize the reservation?
When the User wants to open the locker for any reason, through the touch screen located in the commercial premises, the system will ask him if he wishes to open it and continue the reservation (for example, because he has forgotten to remove or introduce a package) or if he wishes to open it to empty it and finalize the reservation.
If the User wishes to finalize the reservation, they must mark the option to open the locker to empty it and finalize the reservation and, once the locker has been emptied, they must leave it closed so that another User can reserve it.
In the event that the User selects the option to open the locker to empty it and finalize the reservation, the system will automatically unlock said locker so that it can be reserved by other Users.
If the User has left the packages or any object inside the storage room, Lockers for Freedom, SL will not be responsible for what the new User of the locker does with the packages left by the previous User inside the locker.
What can the User do if they have any type of incident in the use of the box office?
In the event of a breakdown, blockage or any other type of technical incident in the use of the locker, as long as it is during business hours, the User will have the assistance service at their disposal. Can the User modify his reservation or withdraw from it?
Once the reservation is made and confirmed, the User will not be able to modify or withdraw from it.
In the event that the User wishes to modify his reservation once it has been made (change of dates or contract more or fewer days than those initially contracted), he must cancel the reservation and make a new one.
ACCEPTANCE AND TEST OF ACCEPTANCE
The acquisition of the products must be made through the website www. lockersforfreedom.com and expresses the total acceptance of each and every one of these General and Particular Conditions as they are shown at that moment in the link that appears on the web page itself and on the touch screen itself, without them being application of the novelties that may occur in the clauses of the General Conditions later.
From the moment of acceptance, the user acquires the condition of Client of Lockers for Freedom described in these General and Particular Conditions. Any product or service offered subsequently by Lockers for Freedom must be subject to a new contract.

ACCESS AND RESERVATION
To be able to contract the rental of lockers Lockers for Freedom It is essential that the following requirements be met:
- Have reached or be over 16 years of age.
- Fill in the necessary information to complete the reservation and payment.
- Accept the present general conditions of contracting the service and use of the ticket offices.
The User must save the code that is sent to the email and/or mobile phone provided by the Client, since it will be essential to enter the business premises, open the locker and collect luggage.
TERMINATION OF SERVICE.
The service will end when the User selects the option to open the locker to leave permanently on the touch screen. In this case, the User must remove all the packages from inside the locker and leave it closed.
If the User has left the packages or any object inside the storage room, Lockers for Freedom SL will not be responsible for what the new User of the locker does with the packages left by the previous User in the locker.
OBLIGATIONS OF THE USER. LIMITS ON THE USE OF LOCKERS.
The User, when contracting the locker rental services Lockers for Freedom is obliged, in particular and without limitation:
- To use the lockers for the sole purpose of depositing your property, which you need to temporarily store in a safe place.
- To use the lockers diligently and, in particular, to ensure that the locker has been properly closed when the User leaves the premises (after inserting the packages or removing them). In the event that the User leaves his locker open with his belongings inside, Lockers for Freedom, SL will not be responsible for its loss, theft or damage that may have been caused.
- Not to use the lockers for illegal or unauthorized purposes. In particular, the User undertakes not to store objects whose mere possession or trafficking is illegal (such as stolen objects, drugs, pornographic materials or, in any way, demeaning to human beings, etc.).
- Not to deposit any property whose possession requires a license without said license or authorization (such as weapons).
- Not to insert in the lockers any type of material that is polluting or dangerous (such as flammable objects or dangerous substances).
- Not to use the lockers to deposit animals or any type of living or deceased being.
- Not to insert food into the lockers, unless it is packaged food that cannot spill, stain the lockers or produce odors of any kind in the premises. Lockers for Freedom
- Not to provide your security key to any third party, being fully responsible for the breach of this obligation and its consequences. The reservation code is personal and non-transferable and can only be used by the holder of the reservation, and cannot be transferred to a third party when the holder of the reservation is going to remove his belongings from the business premises.
- Not to use the lockers to deposit goods that must be collected by a third party. Lockers should not be used as a means of trafficking goods between parties. It is a use that is not authorized Lockers for Freedom
- To access the premises and remain in it for the sole purpose of accessing the rented locker room and only to carry out a specific action in relation to the inserted packages. The User may not remain on the premises for longer than is strictly necessary.
- Not to eat or drink on the premises.
- To remove the packages inserted in the rented lockers, when the rental ends.
- To leave the lockers, at the end of the service, in the same state in which you found them and, in particular, to notify Lockers for Freedom through the email info@lockersforfreedom.com any incident that the User encounters in the use of the lockers or their status.
- Not to take photographs or videos inside the premises Lockers for Freedom (except for what is necessary to capture the reservation/security number) and, in particular and without limitation, not to take photos or recordings of the security mechanisms of the premises.
- Not to include in the lockers money, jewelry, technological items (tablets, computers, televisions, etc.) or goods of special value, being the sole and exclusive responsibility of the user the decision to use the rented lockers to store this type of goods of special value.
- To pay the price of the locker with a credit / debit card owned by you or with the authorization of your owner.
CONSEQUENCES AND LIABILITY OF THE USER IN CASE OF BREACH OF ITS OBLIGATIONS
The User must hold harmless Lockers for Freedom, SL for damages derived from the breach of its obligations derived from this contract, both those included in the previous Clause and those specified in the rest of the Clauses of the same and those derived from the same.
Failure to comply with any of these Conditions may result in the withdrawal or cancellation of the Services by Lockers for Freedom without the need for prior notice to the Client and without this giving the right to any compensation.
Likewise, and in the event of non-compliance with the rental term, non-compliance with the proper use of the lockers and damages caused to the lockers by the Users, the following will apply:
Failure to meet the rental term:
If the User does not remove the packages from the lockers within the rental period, the following rules will apply depending on the case in question:
- If the User does not collect the packages within a period of 30 calendar days (included) from the end of the rental: In this case, the packages will continue in the rented locker, reserving the right to Lockers for Freedom, SL to withdraw them and be able to place them elsewhere. For each day that elapses from the expiration of the rental without the packages having been withdrawn by the User, until their collection by the User, an amount equivalent to the price of the luggage not withdrawn will be accrued per day, regardless of the right of Lockers for Freedom, SL to claim the damages actually suffered.
Lockers for Freedom, SL reserves the right to retain the packages until full payment by the User of the amount owed.
Likewise, if the User requests the return of the shipment packages, the return cost will be assumed 100% by the User and Lockers for Freedom, SL will not assume any risk for the transport of the packages.
If the User requests its shipment, the transportation costs will be paid, prior to its shipment, by the User. Also, in this case Lockers for Freedom, SL will charge an amount of 250 Euros plus VAT for the service provided of having to manage the withdrawal and delivery of the goods to the transport company. Lockers for Freedom, SL reserves the right to retain the packages until full payment by the User of the amount owed.
- After 31 calendar days (included) from the moment the rental term had ended, without the User having proceeded to claim the return of the packages, it will be understood that the goods have been abandoned by the User for all purposes.
Where appropriate, Lockers for Freedom, SL may give them the exit it deems appropriate or convenient, depending on the type of abandoned goods, with total indemnity for Lockers for Freedom, SL
Failure to properly use the instructions:
Lockers for Freedom, SL reserves the right to remove any object that does not comply with the regulations for the use of lockers and is a prohibited object. Where appropriate, Lockers for Freedom, SL will be authorized to call the police or competent authority and report the conduct, as well as to remove the prohibited objects, giving them the exit that they deem appropriate or convenient, with total indemnity for Lockers for Freedom, SL
The User will be responsible for the objects inserted in the lockers.
In any case, the removal of the prohibited packages will entail a penalty of 300 Euros, a penalty that will not exclude the obligation of the defaulting User to indemnify giving him the exit that he deems appropriate or convenient, depending on the type of abandoned goods, with full indemnity for Lockers for Freedom, SL for the damages actually caused.
Damages caused in the lockers and/or premises by the Users
The User will be fully responsible for any damage or deterioration that may be caused to the lockers due to their improper or inappropriate use and to the commercial premises. If applicable, the User must compensate Lockers for Freedom, SL for the physical damages caused in the locker(s) and/or in the business premises as well as for lost profits.
In particular and without limitation, the User causing the damage must pay Lockers for Freedom, SL a daily rental penalty per day in which the storage room is unusable and which is established at 100 Euros per day, as well as the cost of repair or replacement, which is quantified in the case of replacement at €1.000, the above regardless of the damages that could be credited if they were greater.
Any damage that the User may cause to the premises due to its improper or inappropriate use will be penalized with a minimum of 400 Euros, and the aforementioned amount may be increased up to the amount that Lockers for Freedom, SL can justify the damages.

The penalties detailed in this section will be paid by the User with the same means of payment as the one used by the User when contracting the service or by bank transfer to the account indicated by Lockers for Freedom, SL if required by the User. The User expressly accepts that Lockers for Freedom, SL proceeds to collect the amounts established in this section using the User's card or means of payment when contracting the service and presents, if the User requires it, the details of the expenses incurred and the penalties applied.
OBLIGATIONS OF LOCKERS FOR FREEDOM, SL
Lockers for Freedom, SL is obliged to keep the lockers service active and to make available to the User, during the contracted time, the lockers or lockers that the User has contracted in good condition of use.

LIMIT OF LIABILITY OF LOCKERS FOR FREEDOM, SL
Lockers for Freedom, SL offers a service for renting space in lockers, not being responsible for the custody of the packages. The User is solely responsible for the goods included in the rented lockers.
The User, if necessary, must file a complaint with the competent authorities in case of theft, loss or deterioration of the packages stored for any reason.

NON-APPLICATION OF THE PRESENT GENERAL AND PARTICULAR CONDITIONS OF THE CONTRACT
It will not be understood as Customer of Lockers for Freedom, SL and therefore, these General and Specific Contracting Conditions will not apply to those Users who have not reserved their locker through the means offered by Lockers for Freedom, SL (website or in the commercial premises itself, with the use of the software provided for this purpose).
In particular, they will not be understood as Clients of Lockers for Freedom, SL to:
- Those people who accept the Reservation Code provided by another User, either because this User leaves the ticket office or to share it.
- Those people who leave their bags in an open locker without reserving in advance and do not call Lockers for Freedom, SL to try to solve this error.
- Those people who leave their packages outside the lockers provided for this purpose.
- Those people who are in the premises for other purposes than reserving a locker and making use of it.
Claims

LANGUAGE
The language in which the contract between Lockers for Freedom, SL and the Client is Spanish, even if the Client has chosen any other language available on the touch screen to navigate through it.
INTELLECTUAL PROPERTY
The intellectual and industrial property rights over the works, brands, logos, and any other subject to protection, contained on the website and in the commercial premises of Lockers for Freedom correspond exclusively to Lockers for Freedom or to third parties who have authorized their inclusion on the website and/or in the business premises. The unauthorized reproduction, distribution, commercialization or transformation of such works, brands, logos, etc. constitutes an infringement of the intellectual and industrial property rights of Lockers for Freedom or the owner thereof, and may give rise to the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.
Likewise, the information that the Client can access through the web and the touch screen located in the commercial premises may be protected by industrial, intellectual or other property rights. Lockers for Freedom will not be responsible in any case and under any circumstances for infringements of such rights that you may commit as a user.
DATA PROTECTION

The name and surname, telephone number and email provided by the User will be transferred to Drop Point Systems SLU to manage the reservation.
If your personal data also have to be communicated to third party providers, Lockers for Freedom SL will sign the corresponding data processing contract with said providers, in order to guarantee that your personal data is processed by said third parties in accordance with the requirements and guarantees of the LOPD.
Likewise, the User is informed that the data that is subject to treatment through video surveillance will be processed for the purpose that motivated its installation and that is linked to guaranteeing the safety of people, goods and facilities.
The aforementioned recordings will be incorporated into files owned by Lockers for Freedom SL or authorized third parties for security purposes and during the legally established time and will only be transferred to the competent authorities (Judges, Courts or Security Forces and Corps) in case of request or for the defense of the rights of Lockers for Freedom SL or the Users.
The User may exercise the following rights related to their personal data: Access; Rectification; Suppression; Limitation of treatment; Data portability and Opposition.

JURISDICTION AND APPLICABLE LAW
In the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, the Courts and Tribunals that, as the case may be, will be aware of the matter, will be those established by the applicable legal regulations in matters of competent jurisdiction, in which is addressed, in the case of final consumers, to the place of fulfillment of the obligation or to the domicile of the buying party.
All this without prejudice to the right of the Client to go to the Consumer Arbitration Board of his demarcation.
In the case of a sale carried out by a company, both parties submit to Spanish law and, expressly waiving any other jurisdiction, to the Courts and Tribunals of Madrid (Spain).
